Terms of Service

From everyone at TenguMail, thank you for using our service! We build TenguMail to help you automate email workflows with AI. Because we don't know every one of our customers personally, we have to put in place some Terms of Service to help keep the ship afloat.

When we say "Company", "we", "our", or "us" in this document, we are referring to TenguMail. When we say "Services", we mean TenguMail, including our website at tengu.treetank.net and any related applications. When we say "You" or "your", we are referring to the people or organizations that own an account with our Services.

We may update these Terms of Service in the future. Whenever we make a significant change, we will refresh the date at the top of this page and notify you via email. When you use our Services, you are agreeing to the latest Terms. These Terms do contain a limitation of our liability.

Account Terms

  1. You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  2. You may not use the Services for any purpose outlined in our Use Restrictions policy.
  3. You are responsible for all content posted to and activity that occurs under your account, including actions taken by AI assistants you configure.
  4. You must be a human. Accounts registered by "bots" or automated methods are not permitted (your AI assistants inside the service are fine, of course).

Email Access

TenguMail is an email processing platform. By connecting your email account, you authorize us to:

  • Read your emails in the folders you specify. Our IMAP watcher continuously monitors for new messages and processes them according to your configured pipelines.
  • Send emails on your behalf when your AI assistants generate responses. These are sent through your own SMTP server using credentials you provide.
  • Modify your mailbox — mark emails as read, move them to folders, archive, or delete them based on your pipeline rules.
  • Process attachments — extract text, run OCR on images, or store files to your connected cloud storage.

Important: Your email credentials (IMAP/SMTP passwords) are encrypted with AES-256-GCM using a unique key derived for your account. We cannot read your passwords — they are decrypted only when needed to connect to your email server.

You can disconnect your email accounts at any time through Settings. When you disconnect, we stop all monitoring immediately.

AI Processing

TenguMail uses artificial intelligence to understand and respond to your emails. Here is what you need to know:

What gets sent to AI providers

  • Email content (subject, body, sender information)
  • Extracted text from attachments (PDFs, documents, images via OCR)
  • Your assistant instructions and context prompts
  • Conversation history for ongoing email threads

What does NOT get sent

  • Your passwords or API keys
  • Your email server credentials
  • Raw attachment files (only extracted text)

Which AI providers we use

You choose which AI provider processes your data. We support OpenAI, Anthropic, Google (Gemini), Mistral, OpenRouter, and self-hosted Ollama. Each provider has their own privacy policy:

Your relationship with AI providers

You connect your own API keys and credentials to the AI providers you choose. TenguMail acts as a technical tool that facilitates communication between you and your chosen provider — we are not a party to your relationship with them.

This means:

  • You are responsible for accepting the terms of service and privacy policies of any AI provider you use
  • If you need a Data Processing Agreement (DPA) with an AI provider for GDPR compliance, you must arrange that directly with them
  • You are responsible for understanding how each provider handles your data, including data retention and training policies
  • You control which provider processes your data by configuring your own API keys in Settings

We provide the platform; you bring your own AI provider relationship.

AI is not perfect

AI responses are generated automatically and may not always be accurate or appropriate. You are responsible for reviewing AI-generated content before acting on it, especially emails sent on your behalf. We provide tools like "require approval" mode and test pipelines to help you verify behavior before going live.

We do not use your data to train AI models. Your emails are processed solely to provide you with the service.

Payment, Refunds, and Plan Changes

  1. Free is really free. If you are using a free plan, you never need to enter a credit card, and we do not sell your data. Free means free.
  2. Billing. Paid plans are billed monthly or annually in advance through LemonSqueezy. Your billing date is the day you upgraded.
  3. Upgrades and downgrades. Upgrade anytime and the new rate starts immediately. Downgrade anytime and the new rate starts at your next billing cycle.
  4. Cancellation. Cancel anytime from your account settings. Your access continues until the end of your paid period.
  5. Refunds. We have a fair refund policy. If you forgot to cancel a few months ago and have not used the service, contact us — we will give you a full refund. No problem. If you are unhappy for any reason within the first 30 days, we will refund you completely.
  6. Price changes. If we change prices, we will give you at least 30 days notice. We grandfather existing customers when we can.

Cancellation and Termination

  1. How to cancel. You can cancel your subscription anytime from Settings → Account. One click, no questions asked. If you need help, contact us at support@treetank.net.
  2. What happens to your data. When you cancel, your data remains accessible until the end of your billing period. After that, you have a 14-day grace period to download your data or reactivate. After 14 days, all your data is permanently deleted from our active systems. Within 60 days, it is deleted from our backups too.
  3. Account deletion. You can request full account deletion from Settings → Account. This requires canceling any active subscription first. Deletion has a 14-day grace period during which you can change your mind.
  4. We may terminate accounts that violate our Use Restrictions. We will try to contact you first unless the violation is severe. If we terminate your account due to abuse, you forfeit any remaining subscription time.

Uptime, Security, and Privacy

  1. We take uptime seriously but provide Services on an "as is" and "as available" basis. We do not guarantee uninterrupted availability.
  2. We may temporarily disable your account if your usage significantly exceeds average usage or impacts other customers. We will contact you first when possible.
  3. We take many measures to protect your data through encryption, backups, and security monitoring. See our Security Overview for details.
  4. When you use our Services, you entrust us with your data. We process your data as described in our Privacy Policy and for no other purpose.
  5. Our team may access your data only: (a) to help with support requests you make, (b) when an automated process fails and we need to fix it, (c) to ensure security of the service, or (d) as required by law.

Content Ownership

  1. Your content is yours. You retain full ownership of your emails, pipelines, assistant configurations, and all other content you create in TenguMail.
  2. You give us a limited license to use your content solely to provide the Services to you — for example, to process your emails through your configured pipelines.
  3. We do not pre-screen content, but we reserve the right to remove content that violates our Use Restrictions or applicable law.
  4. TenguMail's design, code, and intellectual property remain ours. You may not copy or reuse them without permission.

Features and Bugs

We design TenguMail with care, based on our own experience and customer feedback. However, there is no such thing as a service that pleases everybody. We make no guarantees that our Services will meet your specific requirements.

We test features extensively before shipping. As with any software, bugs happen. We track reported bugs and prioritize security and privacy issues. Not all reported bugs will get fixed immediately, and we do not guarantee completely error-free Services.

Liability

You expressly understand and agree that TenguMail shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from: (i) the use or the inability to use the Services; (ii) unauthorized access to or alteration of your data; (iii) statements or conduct of any third party on the service; (iv) AI-generated content or actions taken by your configured assistants; (v) or any other matter relating to these Terms or the Services.

In other words: choosing to use our Services means you are making a bet on us. If the bet does not work out, that is on you, not us. We do our best to be as safe a bet as possible through careful management, investments in security, and giving a damn. If you choose to use TenguMail, thank you for betting on us.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. For users in the European Union, nothing in these Terms affects your rights under applicable EU consumer protection laws.
